Liability

Disocom S.A.S. and/or the client are not assuming any type of commitment by receiving a free demonstration.

Disocom S.A.S. declares that it is not and will not be responsible for the information provided, its accuracy or inaccuracy, its updating, or any other inconvenience regarding the information provided when it is not generated by the provider and is obtained from other generating sources. In this regard, the client waives any judicial or extrajudicial claim for any reason, for which they declare that they are aware that Company Name is merely a means of accessing said information, and that the latter is not responsible for its authenticity or veracity. In this context, it is clarified that the client agrees not to reproduce, transfer, derive, supply, publish, assign, sell, or in any other way transfer, free of charge or for a fee, the information provided by the provider, neither in part nor in whole. Likewise, they agree to use the information collected through the service exclusively for the purpose of conducting their business and for exclusively commercial purposes. Any other use of the same will make the customer solely responsible and entitle the provider to cancel the service without generating any rights in favor of the customer for such a measure. Likewise, the customer is obligated to keep the information collected and provided within the scope of the business premises or locations where it operates its business; therefore, it must warn any persons directly or indirectly associated with the customer who use or have access to the information that they will be jointly and severally liable with the customer regarding the aforementioned prohibition and for any damages resulting from the violation of this obligation. Failure to warn will make the customer solely responsible, entitling the provider, in this case, to apply a fine of five to twenty times the value of the service provided, without prejudice to the loss of service and without the right to compensation or claim for this in favor of the customer from the provider. The provider will not be responsible for the lack of suitability of the equipment and means used by the customer to access the Internet service or for issues related to the person providing said access (I.P.S.). The provider will also not be responsible for issues related to other basic Internet access providers, such as electricity, telephone, cable modem, or satellite services. Nor will it be liable for any damages that such services may cause to the client. The provider's responsibility is reserved exclusively for maintaining its website online 24 hours a day, every day of the year, and, where applicable, for the timely and proper provision of the magnetic media or media that the provider provides to the client to access its service. The media must be virus-free, certified by the provider in the case of magnetic media, and free of any physical damage. The client may only use the information collected through the service provided by the provider if an illegal activity is detected and, after notifying the provider through reliable means and authorized in writing, will be brought to justice, without prejudice to any criminal liability that may apply to both parties in such matters. The provider is not responsible under any circumstances for the correct or incorrect interpretation of the information contained on the provider's website and/or reports received from third parties, public or private, nor for any damages that may be caused as a direct, indirect, or remote consequence of those who use it. All information provided by the provider will be for the exclusive use of the client and does not constitute advice, value judgment, or discrimination of any kind. Furthermore, the provider is advised of the application of the Habeas Data Law regarding the scope of liabilities that may arise from the use of said information.

Modifications

The provider reserves the right to make changes to the design, information, technical specifications of its own and user equipment, methods of accessing the website, and data transmission, without prejudice to or any rights for the client, who waives any claim based on such circumstances. In the event that the service must be suspended due to technical changes or failures of any kind that hinder or prevent the client from accessing it, the provider will notify the client of the service interruption, the reasons, and the estimated timeframe for its non-provision, with the same scope as stated in the previous article. In these cases, the client will not be entitled to compensation or a refund for the service, without prejudice to the provider's ability to do so as recognition of the inconvenience caused. The client will only be entitled to a claim when said interruption or suspension is carried out untimely or without the aforementioned notice.

Regulations

Regarding information provided by users: Statutory Law 1266 of 2008, which establishes the general provisions of Habeas Data and regulates the handling of information contained in personal databases, especially financial, credit, commercial, service, and third-party information. Decree 2592 of 2010, which regulates Articles 12 and 13 of Statutory Law 1266 of 2008. Decree 1727 of 2009, which determines the manner in which database operators must present data subjects' information.

Intellectual Property

All copyrights and other intellectual property rights in all text, images, and other materials contained on this website are the property of Disocom S.A.S. or have been included with the permission and authorization of the relevant owner. Access to and use of the website includes, but is not limited to, the structure, configuration, design, images, trademarks, logos, photographs, and other elements included therein and, in general, all creations expressed on the website, whether or not they are subject to intellectual property rights under applicable Colombian intellectual property regulations, are the property of Disocom S.A.S. Copying of any material protected by intellectual property rights, nor its modification, transformation, reproduction, or retransmission through any website or other means, is prohibited without the prior written consent of the rights holders.
